These Terms of Service (“Terms”) govern your use of cmjjassociation.com (“Site”) and any related services provided by CMJJ Association (“we,” “our,” “us”). By accessing or using our Site or services, including opting in to receive SMS messages, you agree to be bound by these Terms. If you do not agree, you should not use our services.

Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the websites, events, memberships, training, and related services offered by [Legal Business Name] (d/b/a CMJJ Association) (“Company,” “we,” “us,” or “our”). By accessing or using our Site or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.

Texas-Only Scope

These Terms are tailored for operations in the State of Texas and U.S. federal law. We do not incorporate non-U.S. or other state-specific provisions.

Use of Our Services

  • You agree to use our Site and services only for lawful purposes and in compliance with these Terms and all applicable laws.
  • You will not misuse our services, attempt to gain unauthorized access, or interfere with the functioning or security of the Site.
  • You agree not to upload or transmit content that is illegal, infringing, harassing, hateful, or involves sexually explicit, tobacco, firearms, or other content prohibited by our policies (collectively, “SHAFT” content), especially in connection with messaging or community features.

Accounts and Purchases

  • If you create an account or purchase services, you must provide accurate and complete information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
  • Fees and charges are due at the time of purchase unless otherwise stated. All sales are final unless our Refund & Cancellation Policy applies.

Recurring Billing & Autorenewal (ROSCA)

If you enroll in a membership or other subscription, you authorize us to charge your payment method on a recurring basis at the disclosed interval and rate until you cancel. We will present the key terms (price, billing interval, how to cancel) clearly at checkout. To cancel, follow the instructions in your account settings or contact us at hello@machadomethod.com or via [Cancellation Method(s)]. Cancellations take effect at the end of the current billing period unless otherwise stated. We may send renewal reminders where required.

Refund & Cancellation Policy

  • Seminars & events: Refunds may be requested up to 14 days prior to the event; after this period, all sales are final.
  • Memberships: Month-to-month memberships may be canceled with 30 days’ written notice. Prepaid terms are non-refundable except where required by law.
  • Merchandise: Returns accepted within 14 days of delivery for unused items in original condition.

Payment Authorization

By submitting a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge it for purchases, recurring fees, taxes, and any unpaid amounts. You agree to resolve any billing disputes with us first and not to make fraudulent or abusive chargebacks.

E-Sign Disclosure & Electronic Communications

You consent to receive contracts, disclosures, notices, and confirmations electronically, including via email and SMS (where you have opted in). You may withdraw consent by contacting us, but doing so may affect your ability to use certain services. Print or save copies for your records.

SMS Messaging Terms (A2P Compliance)

  • Opt-In: By providing your mobile number and explicitly opting in, you consent to receive SMS messages from CMJJ Association related to updates, reminders, and promotions.
  • Frequency: Message frequency [Message Frequency] and will not exceed what was disclosed at opt-in.
  • Opt-Out: Reply STOP at any time to unsubscribe. You will receive a confirmation and no further SMS will be sent.
  • HELP: Reply HELP or email hello@machadomethod.com.
  • Rates: Message and data rates may apply.
  • No Sharing: We will not sell or transfer your phone number or SMS consent data for third-party marketing.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Consent Source: Your consent is captured and stored (method, timestamp, source) for compliance and audit purposes.

Community Code of Conduct

  • Members agree to maintain respect and professionalism in all interactions, online or in person.
  • We may suspend or terminate access for harassment, abuse, threats, illegal activity, or conduct harmful to our community or brand.

User Content; License; Takedown

If you post or submit content, you grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display such content to operate and promote the services. You represent you have the necessary rights. We may remove content that violates laws or these Terms. To report alleged infringement (DMCA), contact hello@machadomethod.com.

Event, Training & Physical Activity Waiver

Some services involve physical activity or training. By participating, you acknowledge inherent risks, agree to use good judgment, and represent that you are medically fit to participate. To the fullest extent permitted by Texas law, you assume those risks and release the Company from liability for ordinary negligence. This waiver does not apply to gross negligence, willful misconduct, or violations of law.

Intellectual Property

Informal Resolution: Before filing a claim, you agree to email us at hello@machadomethod.com and attempt to resolve the dispute informally within 30 days.

Arbitration & Venue (Optional): Except for small-claims or injunctive relief, disputes may be resolved by binding arbitration in Texas under the Federal Arbitration Act and AAA Consumer Rules. Class actions and jury trials are waived to the extent permitted by law. You may opt out of arbitration within 30 days of accepting these Terms by emailing us with your name and the statement “I opt out of arbitration.” If arbitration is not used, the exclusive venue is the state or federal courts located in Texas, and both parties consent to personal jurisdiction there.

Changes to These Terms

We may update these Terms periodically. Changes will be posted with a revised “Last Updated” date. Your continued use after changes constitutes acceptance.
